1. Eligibility: This Sweepstakes is open only to legal United States residents residing in the fifty (50) United States and the District of Columbia, who are twenty-one (21) years of age or older and who have never been a Rosie’s Rewards member. The Sweepstakes is not open to existing Rewards Members. The Sweepstakes is void where prohibited by law. Employees of Colonial Downs Group, LLC, doing business as “Rosie’s Gaming Emporium,” its parent, affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
2. Agreement to Rules: By participating, the entrant (“You”) agrees to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, you agree to accept the decisions of Rosie’s Gaming Emporium as final and binding as it relates to the content of this Sweepstakes.
3. Sweepstakes Period: Sweepstakes takes place from July 6, 2023 at 8AM EST to September 21, 2023 at 11:59PM EST (the “Sweepstakes Period”).
4. How to Enter: To enter the Sweepstakes, during the Sweepstakes Period, go to https://rosiesgaming.com/emporia-2/ and complete the registration form in its entirety to receive one (1) entry into the Sweepstakes. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Rosie’s Gaming Emporium. You may enter only once. You must provide the information requested. You may not enter more times than indicated by using multiple cell phone numbers, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Rosie’s Gaming Emporium.Bonus Entry:To receive one (1) additional entry, using a two-way text-messaging capable device (“Device”), text LUCKY to the short code 90701. You will receive a reply Text Message from Sponsor confirming your agreement to Sponsor’s Text Message terms. You must use the same phone number you provided during initial registration to send your text message for a bonus entry or you will not receive a bonus entry. You must reply to this message as directed to receive an entry into the Sweepstakes. If you participate via the Text Message method of entry, you may receive one (1) or more text messages in response to your text message, including legal disclaimers from the Sponsor, and you agree to accept any applicable charges associated therewith. By texting the Keyword to the Short Code, you agree that you are providing Sponsor express, written consent for you to receive up to 10 promotional text messages per month using automated technology. You may opt-out of receiving the promotional text messages from Sponsor at any time by sending a reply text message with the word “STOP”. By participating via text, you agree to receive recurring automated marketing text messages from Sponsor at the cell number used for participation. Consent is not a condition of any purchase. 5. Prizes: Four (4) Prizes are available. Each Prize consists of $2,500 cash.Prize must be claimed in person at Rosie’s Gaming in Emporia, VA within seven (7) days of the random drawing. To claim a prize, winner must first become a member of Rosie’s Rewards. Rosie’s Rewards is free to join. For more information visit Rosie’s Gaming Emporium® in Virginia. If prize is not claimed in person within seven (7) days, prize will be forfeited and an alternate winner may be selected at the sole discretion of Sponsor.Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others by Winner is permitted. Acceptance of a prize constitutes prize winner’s permission for Sponsor and its designees to use prize winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation, unless prohibited by law.
6. Odds: The odds of winning depend on the number of eligible entries received.
7. Winner Selection and Notification: Four (4) potential winners will be selected by a random drawing under the supervision of Rosie’s Gaming Emporium on September 25, 2023 at 10AM at Rosie’s Gaming Emporium in Emporia, VA. Winners need not be present to win. Winners will be notified via phone and/or email using contact information provided or collected at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of a prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. Any potential prize winner must execute and return an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, “Prize Claim Documents”). If winner fails or refuses to sign and return all Prize Claim Documents within five (5) days of prize notification (or a shorter time if required by exigencies), winner may be disqualified and an alternate winner may be selected.. Receipt by Winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT Rosie’s Gaming Emporium’s SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. Terms & Conditions: Rosie’s Gaming Emporium reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Rosie’s Gaming Emporium’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, Rosie’s Gaming Emporium may select the potential winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Rosie’s Gaming Emporium. Rosie’s Gaming Emporium reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Rules. Rosie’s Gaming Emporium has the right, in its sole discretion, to maintain the integrity of the Sweepstakes and to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same mobile device in excess of that allowed by Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, Rosie’s Gaming Emporium reserves the right to seek damages to the fullest extent permitted by law. Rosie’s Gaming Emporium reserves the right to substitute a cash prize for a retail prize. Substitution will be of greater or equal cash value of original prize.
9. Excluded Patrons. Persons who have been excluded from Rosie’s Gaming Emporium, or who have requested self-exclusion from the property, or who are on an Exclusion List are not eligible to participate in the Sweepstakes. In the event an ineligible person should attempt to receive a prize, the winning entry for the prize shall be deemed void.
10. Limitation of Liability and Indemnification: By entering, You agree to release and hold harmless Rosie’s Gaming Emporium and its parent, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, and assigns, and each of their employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error in the administration of the Sweepstakes or the processing of entries. Entrants shall indemnify, defend and hold harmless Rosie’s Gaming Emporium, and their respective officers, employees, and agents, against any damage, loss, claim, or liability arising from his or her participation in this Sweepstakes. Rosie’s Gaming Emporium assumes no liability of any kind for any property loss or damage or personal injury occurring in connection with any prizes.
11. Disputes: THIS Sweepstakes IS GOVERNED BY THE LAWS OF the United States of America AND Virginia, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The number of arbitrators shall be one. The place of arbitration shall be Richmond, Virginia. Virginia law shall apply. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes). Participant further waives all rights to have damages multiplied or increased.

13. The Sweepstakes is sponsored by Colonial Downs Group, LLC d/b/a Rosie’s Gaming Emporium and is in no way sponsored, endorsed, administered by, or associated with Facebook.
14. By participating in the Sweepstakes, all entrants affirm that they have reviewed, accepted, and agreed to all of the Official Rules.
