Eligibility:
This Contest is open only to legal residents of the Commonwealth of Virginia who are eighteen (18) years of age or older at the time of entry. All band members participating in a submission must be at least eighteen (18) years old. The Contest is void where prohibited by law. Employees of Colonial Downs Group, LLC, doing business as “Colonial Downs,” its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
Agreement to Rules:
By participating, the Contestant (“You”) agrees to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Colonial Downs Racetrack, Colonial Downs Group, and CDI as final and binding as it relates to the content of this Contest, whose decisions are final.
Contest Period:
Entries will be accepted online beginning May 29th, 2026, at 12:00 PM EST and ending June 26, 2026, at 11:59 PM EST.
- Selected finalists will participate in a fan-voted social media contest running from July 1, 2026, through July 20, 2026.
- Winners will be announced on July 30, 2026.
How to Enter:
The Contest must be entered by filling out and submitting the official entry form located at https://rosiesgaming.com/battle-of-the-bands/. Bands must submit a performance video for consideration. Submission videos must be original content created and performed by the entering band and must be submitted in .mp4 file format and be of sufficient audio and video quality for review and promotional use. Submitted videos may be used during all stages of judging and voting if the band progresses in the Contest.
- Music and performances must be appropriate for a public, family-friendly environment. Colonial Downs reserves the right, in its sole discretion, to disqualify any submission deemed inappropriate or in violation of contest guidelines.
Additional Entries:
No additional entries may be earned. Limit one (1) entry per band.
Prizes:
- 1st Place – $2,500 cash prize and a live performance opportunity at Colonial Downs Racetrack on September 7, 2026.
- 2nd Place – $1,000 cash prize and a live performance opportunity at Colonial Downs Racetrack on September 6, 2026
- 3rd Place – $500 cash prize and a live performance opportunity at Colonial Downs Racetrack on September 5, 2026
The specifics of all prizes shall be solely determined by Colonial Downs Racetrack. No prize substitution shall be permitted except at Colonial Downs’ discretion. Prizes are nontransferable. Any and all prize-related expenses, including without limitation any federal, state, and/or local taxes, shall be the sole responsibility of the winners. Acceptance of any prize constitutes permission for Colonial Downs Racetrack, Colonial Downs Group, and CDI to use the winners’ names, likenesses, band names, submitted content, and performances for purposes of advertising and trade without further compensation, unless prohibited by law.

1st Place Prize:
The one (1) first-place winner of the Contest will receive a $2,500 cash prize and the opportunity to perform live at Colonial Downs Racetrack on Sunday, September 7, 2025. The specifics of the prize shall be solely determined by Colonial Downs Racetrack. No prize substitution shall be permitted except at Colonial Downs’ discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Colonial Downs Racetrack, Colonial Downs Group, and CDI to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
2nd Place Prize:
The one (1) second-place winner of the Contest will receive a $1,000 cash prize and the opportunity to perform live at Colonial Downs Racetrack on Saturday, September 6, 2025. The specifics of the prize shall be solely determined by Colonial Downs Racetrack. No prize substitution shall be permitted except at Colonial Downs’ discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Colonial Downs Racetrack, Colonial Downs Group, and CDI to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
3rd Place Prize:
The one (1) third-place winner of the Contest will receive a $500 cash prize and the opportunity to perform live at Colonial Downs Racetrack on Friday, September 5, 2025. The specifics of the prize shall be solely determined by Colonial Downs Racetrack. No prize substitution shall be permitted except at Colonial Downs’ discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Colonial Downs Racetrack, Colonial Downs Group, and CDI to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
Odds: The odds of winning depend on the number of eligible votes received.
Winner Selection and Notification: Winners will be selected by social vote using the WooBox module and under the supervision of Colonial Downs Shared Services Marketing. Top three (3) will be notified via phone and/or email within 48 hours following selection. Colonial Downs shall have no liability for Winners’ failure to receive notices due to incorrect number, or email, on file, full voicemail, out of service number, or other security settings or for Winners’ provision of incorrect or otherwise non-functioning contact information. If Winners cannot be contacted, is ineligible, fails to claim the prize within 24 hours from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and alternate Winners will be selected until all four (4) prizes are claimed. Receipt by Winners of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNERS (AT Colonial Downs’s SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNERS OF THE CONTEST, AND ALL PRIVILEGES AS WINNERS WILL BE IMMEDIATELY TERMINATED. The Grand Prize Winner will be announced on Facebook on Saturday, August 9, 2025.
Rights Granted by You: By entering this content (e.g., photo, video, etc.), You understand and agree that Colonial Downs Racetrack, anyone acting on behalf of Colonial Downs Racetrack and Colonial Downs’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent.
Terms & Conditions: Colonial Downs Racetrack, Colonial Downs Group, and CDI reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Colonial Downs’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Colonial Downs may select the Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Colonial Downs. Colonial Downs reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. Colonial Downs has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same mobile device in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, Colonial Downs reserves the right to seek damages to the fullest extent permitted by law. Colonial Downs reserves the right to substitute a cash prize for a retail prize. Substitution will be of greater or equal cash value of original prize.
Excluded Patrons. Persons who have been excluded from Rosie’s Gaming Emporium, Colonial Downs, The Rose Gaming Resort or who have requested self-exclusion from the property, or who are on a State Exclusion List are not eligible to participate in the Contest. In the event an ineligible person should attempt to receive a prize, the winning entry for the prize shall be deemed void.
Limitation of Liability and Indemnification: By entering, You agree to release and hold harmless Colonial Downs Racetrack, Colonial Downs Group, CDI, and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries. You shall indemnify, defend, and hold harmless Colonial Downs, and their respective officers, employees, and agents, against any damage, loss, claim, or liability arising from his or her participation in this Contest. Colonial Downs assumes no liability of any kind for any property loss or damage or personal injury occurring in connection with any prizes.
Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF THE United States of America AND Virginia, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The number of arbitrators shall be one. The place of arbitration shall be Richmond, Virginia. Virginia law shall apply. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.
