Weiner Dog Racing Participation Agreement

As consideration for attending and participating in the Event, I, for myself, my spouse, heirs, estate, legal representatives and assigns, hereby acknowledge and agree as follows:

1. I am voluntarily participating in the Event with knowledge of the numerous risks associated with the Event, which could lead to injury to my personal property or myself (including serious life-altering injuries or death), and hereby knowingly assume all such risks.
2. Colonial Downs Group, L.L.C. d/b/a Colonial Downs (“Churchill”), its parents, subsidiaries, affiliates, and their respective employees, agents, servants, shareholders, managers, members, officers, directors, successors, and assigns and insurers (collectively, the “Churchill Parties”) are not responsible for any loss, damages, expenses (including attorneys’ fees) or injuries that I or others may experience related to my attendance at and participation in the Event. In connection with the foregoing, I agree to waive any rights I may have with respect to such losses and reimburse the Churchill Parties if I or others make a claim against them for any damages, expenses (including attorneys’ fees), or injuries I or others may suffer or incur related to my attendance at and participation in the Event.
3. This Event Participation Agreement may be used by the Churchill Parties as a complete defense to any claim or entitlement that I may subsequently assert against the Churchill Parties related to any matter arising out of the Event.
4. If any portion of this Event Participation Agreement is held to be invalid or unenforceable, all other provisions shall nevertheless continue to be valid and enforceable. This Event Participation Agreement supersedes any oral or written statements made by or to me in connection with the Event and is the entire agreement between me and Churchill with respect to the Event. I understand that I cannot terminate, cancel, or revoke this Event Participation Agreement for any reason.
5. Any dispute relating to my attendance at and participation in the Event shall be resolved exclusively by binding arbitration according to the then existing rules of the American Arbitration Association in Richmond, Virginia. Such proceedings and this Event Participation Agreement will be governed, construed, and interpreted by the laws of the Commonwealth of Virginia irrespective of its conflict of law principles.
6. I hereby give Churchill, its legal representatives, successors and assigns and all persons or corporations for whom it is acting the absolute right and unrestricted permission to copyright and/or use, publish photographic portraits/pictures or videos of me, still, single or multiple, or in which I may be included in whole or in part, or composite, or otherwise, made through any media for art, advertising, trade, internet or any other lawful purpose. I hereby waive any right to inspect or approve the finished product of the photo, video or advertising that may be used in connection therewith, or the use to which it may be applied. I hereby release, discharge and agree to hold harmless the corporation, its nominees or others for whom the photographer is acting from any liability by virtue or any use whatsoever, whether intentional or otherwise, that may occur or be produced in the tasking of said picture, or in any processing tending towards the completion of the finished product. My presence shall be binding upon the subject/model and his/her respective heirs, successors and assigns.
